This Limited Warranty is issued by Apex Optics, and its affiliated entities, including Apex Optics USA (collectively, “Apex Optics,” “we,” “our,” or “us”). This Limited Warranty applies to Apex Optics products purchased through authorized dealers or directly from Apex Optics in the United States or Canada.

1. Lifetime Optical and Mechanical Warranty

Apex Optics warrants that the optical and mechanical components of its products shall be free from defects in materials and workmanship for the lifetime of the product, subject to the terms, conditions, limitations, and exclusions set forth herein.

If Apex Optics determines, upon inspection, that a product contains a defect in materials or workmanship under normal use, Apex Optics will, at its sole discretion, repair the product or replace it with the same model or a comparable model.

2. Electronic Component Warranty

Electronic components, including but not limited to laser rangefinders, displays, circuit boards, control modules, Bluetooth modules, integrated electronics, and similar electronic systems, are warranted to be free from defects in materials and workmanship for a period of three (3) years from the original date of retail purchase.

Electronic component coverage applies only to the original retail purchaser and is not transferable. Electronic warranty coverage expires three (3) years from the original date of purchase regardless of any transfer of ownership.

3. Eligibility and Proof of Purchase

This Limited Warranty applies only to products purchased from authorized Apex Optics dealers or directly from Apex Optics.

The original retail purchaser must provide valid proof of purchase showing the date and place of purchase to obtain warranty service.

4. Transfer of Lifetime Optical Warranty

The lifetime optical and mechanical warranty may be transferred one (1) time to a subsequent owner, provided that:

a. The transfer is registered with Apex Optics within thirty (30) days of the change in ownership;

b. The subsequent owner provides proof of the original retail purchase;

c. The product was originally purchased through an authorized dealer; and

d. Apex Optics approves the transfer following review.

Warranty coverage continues from the original date of purchase and does not reset, renew, or extend due to transfer.

Apex Optics reserves the right to deny any transfer request that does not comply with these requirements.

5. Exclusions

This Limited Warranty does not cover, and Apex Optics shall have no obligation with respect to, any damage or failure resulting from:

• Accidental damage, impact, or dropping

• Tip-over from tripods, mounts, vehicles, or unstable surfaces

• Crushing, external force, or collision

• Improper mounting, installation, or alignment

• Misuse, abuse, neglect, or improper storage

• Unauthorized disassembly, modification, or repair

• Firmware alteration or tampering

• Improper battery installation or battery leakage

• Water intrusion resulting from impact or damage

• Theft or loss

• Cosmetic damage that does not affect functional performance

• Fire, flood, lightning, or other acts of nature

• Normal wear and tear

Damage resulting from external force, impact, or mishandling is not considered a defect in materials or workmanship.

Accessory items including, but not limited to, lens covers, flip covers, throw levers, plugs, mounts, straps, caps, and similar components are excluded from lifetime warranty coverage.

6. Inspection and Determination of Coverage

All products submitted for warranty service are subject to inspection by Apex Optics. Apex Optics reserves the sole and exclusive right to determine whether a product qualifies for warranty coverage under this Limited Warranty.

If a product is determined not to be covered, Apex Optics may, at its discretion, offer repair or replacement services at a reasonable service fee.

7. Remedy Limitation

Repair or replacement of a product, at Apex Optics’ sole discretion, shall be the exclusive remedy under this Limited Warranty.

To the maximum extent permitted by applicable law, Apex Optics shall not be liable for any incidental, consequential, indirect, special, or punitive damages, including but not limited to loss of use, loss of profits, loss of opportunity, or damage to other property, arising out of or relating to the use or inability to use the product.

8. Disclaimer of Other Warranties

Except as expressly stated in this Limited Warranty, Apex Optics makes no other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose.

To the extent that implied warranties cannot be disclaimed under applicable law, such implied warranties are limited in duration to the applicable warranty period set forth above.

Some jurisdictions do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so certain limitations may not apply to you.

9. Governing Law

For products purchased in Canada, this Limited Warranty shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

For products purchased in the United States, this Limited Warranty shall be governed by and construed in accordance with the laws of the State in which the product was originally purchased, without regard to conflict of law principles.

10. Severability

If any provision of this Limited Warranty is found to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.

11. Legal Rights

This Limited Warranty gives you specific legal rights, and you may also have other rights that vary by state, province, or jurisdiction.
